OSUN STATE GOVERNMENT V. DALAMI NIG. LIMITED (2003) 7 NWLR (PART 818) 72 – Court of Appeal

This Appeal arose out of a suit for wrongful termination and a claim, among other things for general damages to the tune of N85 million. The latter claim was granted by the trial Court. The appellant challenged the award of general damages to the tune of N85 million on the basis that the learned trial Judge did not apply the correct principles of law in governing the award of damages to the Respondent.

The Court relying on case law and Section 16 of the Court of Appeal Rules, held that this leg of the grounds of Appeal was successfully determined as the trial Court did not give enough reasons on how it arrived at the said award. Consequently, the case was remitted to the trial Court to decide.
